What is the purpose, legal basis and scope of personal data processing?

  • conclusion and implementation of the contract for the sale of products, including payment processing, shipment of the order, handling of returns and exchanges of products, communication with the website user in connection with the service provided:
  • basis for processing: art. 6 sec. 1 lit. b) GDPR (processing is necessary to perform the contract);
  • scope of personal data processed (ordinary data only):
    - ordering party's data: name, surname, company name and tax identification number (optional), address, e-mail address, telephone number, IP address;
    - shipping details (order collector): name, surname, company name (optional), address, e-mail address, telephone number for the shipper;
    - ordered products and their value, selected form of delivery and its value, discount (optional), total value to be paid;
    - payment status (e.g. paid, refused) and selected payment channel (e.g. mTransfer, payment card);
    - shipment number (assigned automatically by the carrier's system) and shipment status (based on its number, from commonly available shipment tracking systems);
    - personal data on the Customer Account (entered voluntarily by the User and administered by him): name and surname, company name and tax identification number (optional), address, shipping address, e-mail address, telephone number;

 

  • handling complaints, including mediation in the transfer of claims to carriers and online payment operators
    • - basis for processing: art. 6 sec. 1 lit. b) GDPR (processing is necessary for the proper performance of the contract);

 

  • scope of personal data processed (ordinary data only):

- name and surname of the person submitting the complaint,
- contact details: correspondence address, e-mail address, telephone number,
- the reason and details of the subject of the complaint,
- Customer's requests to the store.

 

  • direct marketing of own products and services, via e-mail newsletter and SMS newsletter, based on a voluntarily granted consent:

basis for processing: art. 6 sec. 1 lit. f) GDPR (processing is necessary for the purposes of the legitimate interests pursued by the data controller or by a third party);
- scope of personal data processing (ordinary data only):
- e-mail newsletter: e-mail address
- SMS newsletter: name or nickname, telephone number.

 

  • ensuring the security of the website and the protection of its users' data:

- basis for processing: art. 6 sec. 1 lit. f) GDPR (processing is necessary for the purposes of the legitimate interests pursued by the data controller or by a third party);
- scope of personal data processed: login data to the online store (IP address, date and time).

We also process anonymised data related to the use of the store (e.g. the number of visitors, the most viewed products) to generate statistics. These data are aggregate and anonymous, i.e. they do not contain features that identify people using the store. The legal basis for processing is Art. 6 sec. 1 point f of GDPR - the legitimate interests of the administrator, which are the running and development of the Company's operations, enriching the offer for customers, presenting services as well as testing and improving quality.

 

Who do we share personal data with?

The data is made available only to the extent necessary for the proper functioning of the online store, order fulfillment and for legal and tax purposes, on the basis of concluded contracts.

In addition, we may be required to provide personal data to tax authorities and law enforcement authorities on the basis of applicable law.

How long will we store your personal data?

Personal data related to the conclusion and implementation of the contract for the sale of products and related to the handling of complaints are stored for the duration of the company's operation, not less than 2 years (to handle complaints) and not longer than 10 years (for accounting and tax purposes).

The personal data provided by the Customer during the voluntary registration of the Customer Account are stored until they are deleted by the Customer.

Personal data for direct marketing purposes is stored until the consent to the processing of data for this purpose is withdrawn.

What are your rights?

In connection with the processing of personal data, the Customer has the following rights:

 

  • the right to access personal data, including the right to obtain a copy of this data;
  • the right to request rectification (correction) of personal data - if the data is incorrect or incomplete;
  • the right to request the deletion of personal data (the so-called right to be forgotten), if:

 

 

- the data are no longer necessary for the purposes for which they were collected or otherwise processed,
- the data subject has objected to the processing of personal data,
- the data subject has withdrawn consent to the processing of personal data, which is the basis for data processing and there is no other legal basis for data processing,
- personal data is processed unlawfully,
- personal data must be removed in order to comply with the legal obligation;

  • the right to request the restriction of the processing of personal data - if:

- the data subject questions the correctness of the personal data,
- data processing is unlawful, and the data subject opposes the deletion of data, requesting their restriction instead,
- The administrator no longer needs the data for his purposes, but the data subject needs them to establish, defend or pursue claims,
- the data subject has objected to the processing of data, pending determination of whether the legitimate grounds on the part of the administrator override the grounds of objection;

  • the right to transfer data - if the following conditions are jointly met:

- data processing takes place on the basis of an agreement concluded with the data subject or on the basis of the consent expressed by that person,
- processing is carried out in an automated manner;

  • the right to object to the processing of data - if the following conditions are jointly met:

- there will be reasons related to your particular situation, in the case of data processing on the basis of a task carried out in the public interest or as part of the exercise of public authority by the Administrator,
- processing is necessary for the purposes of the legitimate interests pursued by the Administrator or by a third party, except where these interests are overridden by the interests or fundamental rights and freedoms of the data subject, requiring the protection of personal data, in particular when the data subject is a child.

If the processing of personal data is based on the consent of the person to the processing of personal data (Article 6 (1) (a) of the GDPR), the Customer has the right to withdraw this consent at any time. This withdrawal does not affect the compliance of the processing, which was carried out on the basis of consent before its withdrawal, with applicable law.

Do we process personal data automatically (including through profiling) in a way that affects your rights?

We analyze the data only in a non-automated manner in order to offer customers tailored products, e.g. by sending a newsletter or remarketing.

Cookies

The Masculo.pl store uses cookies. These are small text files sent by a web server and stored by the browser computer software. Detailed information on cookies, as well as the history of their creation, can be found, among others here: http://pl.wikipedia.org/wiki/Ciasteczko. The Service Provider may process the data contained in Cookies when visitors use the Masculo.pl website for the following purposes:

  • implementation of the basic functionalities of the store, such as identifying customers as logged in and maintaining login sessions, storing dynamic data, e.g. statistics, summaries;
  • adjusting the content of the store to the individual preferences of the customer (e.g. regarding the website language);
  • remembering the IP location, time zone;
  • keeping anonymous statistics showing how to use the store.

By default, most web browsers available on the market accept cookies by default. Everyone has the option to define the terms of using cookies using the settings of their own web browser. This means that you can, for example, partially limit (e.g. temporarily) or completely disable the option of saving cookies - in the latter case, however, it may affect some of the store's functionalities. The web browser settings for cookies are important from the point of view of consent to the use of cookies by our store - in accordance with the law, such consent may also be expressed through the settings of the web browser. In the absence of such consent, the browser settings for cookies should be changed accordingly. At the same time, we use Google Analytics and Universal Analytics services provided by Google Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, USA). The collected data is processed as part of the above services in an anonymised manner. These are the so-called operating data that make it impossible to identify a person and are presented to the store administrator in a collective statistical form and are in no way associated with a specific order, in particular with the customer's personal data. They are used to generate statistics helpful in administering the store. The Store may share anonymised data (i.e. those that do not identify specific Users) with external service providers, trusted partners or research agencies in order to better recognize the attractiveness of advertising and services to Users, improve the overall quality and efficiency of services provided by the store.

Google Analytics and Universal Analytics allows the store administrator to direct store ads to the store visitors, at a later date, through the "Google network" (all places where AdWords ads may be displayed; includes, among others, Google sites, Google partner sites and other destinations , such as mobile phone applications) - the so-called remarketing. In addition, we use Facebook Ads, which allow the store administrator to direct store ads to store visitors, at a later date, through Facebook and Instagram pages and mobile services.
